What if I am injured on the job?
There are complicated set of legal issues that could occur: (1) There is the administrative process of Worker’s Comp in Colorado. If you are denied, then you can go through (a) an administrative appeal and (2) after final agency action is issued at Worker’s Comp, then you can appeal the result to the courts. Worker’s Comp lawyer help with the administrative process, and often the civil court as well. (2) Also in the (usually) state civil court, you can sue a third-party (not the employer against whom the exclusive remedy is the Worker’s Comp process) for personal injuries caused by an accident while at work. (3) You might have a federal, but sometimes state law in a Worker’s Comp context, employment and/or civil rights claim against the employer for wrongful discharge, e.g. illegally firing you in retaliation for exercising your administrative rights under the state Worker’s Comp statute.
